You must be at least 18 years of age to use the Service. If you choose to use the Service, you’re representing and warranting that you are 18 years of age or older and that you have the right, authority and capacity to enter, agree to and abide by these Terms.
If you are opening or using an account with Contact IQ on behalf of a company, entity or organization (“Organization”) then you represent and warrant that you: (i) are an authorized representative of that Organization with the authority to bind such organization to these terms, and (ii) have read the Terms; (iii) understand these terms, and (iv) agree to these Terms on behalf of your Organization.
If you use the Service, you take responsibility for ensuring that your use complies with all laws, rules and regulations applicable to you. If the use of the Service is not permitted, then these Terms are void.
All registration information you submit must be accurate and truthful and you agree to maintain the accuracy of such information. In short, don’t make stuff up and please, keep things updated.
We and our licensors own and retain all proprietary rights in the Service. The Service may contain the copyrighted material (such as text, graphics, photographs, images, and illustrations), trademarks, and other proprietary information of us and our licensors (the “Content”). Except for Content that is in the public domain or for which permission has been provided, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any Content. Content and the Service are protected by copyright as collective works and/or compilations, pursuant to U.S. copyright laws, international conventions, and other copyright laws.
Subject to these Terms and for the sole and limited purpose of facilitating your use of the Service, we grant to you a limited, revocable, non-exclusive license to (i) access and use the Service (including the Content contained therein), and (ii) install, access and use the Service on devices owned by you.
We reserve the right to exercise whatever lawful means it deems necessary to prevent unauthorized use of the Service, including, but not limited to, technological barriers, IP mapping, and directly contacting your Internet Service Provider (ISP) regarding such unauthorized use.
You understand that when using the Service you may be exposed to information from Third Party Accounts or other content from a variety of sources, and that we are not responsible for the accuracy, usefulness, or intellectual property rights of or relating to such content. You further understand and acknowledge that you may be exposed to information that is inaccurate, offensive, indecent or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against us. We do not endorse any information or any opinion, recommendation or advice expressed therein, and we expressly disclaim any and all liability in connection with information from Third Party Accounts. If notified by a User or a content owner of content that allegedly does not conform to this Terms of Service, we may investigate the allegation and determine in our sole discretion whether to remove it. We reserves the right to do this at any time and without notice. For clarity, we do not permit copyright infringing activities on the Service.
As we mentioned above, the Service contains links to Third Party Websites that are not owned or controlled by Contact IQ ( for example Twitter links). We don’t own or have control over anything from or about these Third Party Websites, now we will say the same thing several different ways. When you access those Third Party Websites, you do so at your own risk and under their terms of service and privacy policies. You hereby represent and warrant that you have read and agree to be bound by all applicable policies of any Third Party Websites and that you will act in accordance with those policies, in addition to your obligations to Contact IQ under these Terms. Contact IQ has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of any Third Party Websites. In addition, Contact IQ will not and cannot monitor, verify, censor or edit the content of any Third Party Website. Any information contained in the content or data from a Third Party Website may be inaccurate or misleading and should not be relied upon. This content and data may become temporarily or permanently unavailable and/or may be subject to change without notice. By using the Service, you expressly release and hold harmless Contact IQ from any and all liability arising from your use of any Third Party Website.
By accessing the Service, you consent to receive periodic email communications regarding the Services, new product offers, promotions and other matters.
This should go without saying, by accessing the Service, you agree that you will not contribute any content or otherwise use the Service in a manner that: (i) infringes or violates the intellectual property rights or proprietary rights, rights of publicity or privacy, or other rights of any third party; (ii) violates any law, statute, ordinance or regulation; (iii) is harmful, fraudulent, deceptive, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable; (iv) involves commercial activities and/or sales without Contact IQ’s prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes; (v) impersonates any person or entity, including without limitation any employee or representative of Contact IQ; ( vi) contains a virus, trojan horse, worm, time bomb, or other harmful computer code, file, or program; (vii) uses any manual or automated software, devices, or other processes to “crawl,” “scrape,” or “spider” any page of the Service; (viii) attempts to decompile, reverse engineer, or otherwise attempt to obtain the source code of the Service or (ix) makes Illegal and/or unauthorized uses of the Service, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email or other communications, are prohibited. Contact IQ may change, suspend or discontinue the Service at any time, including the availability of any feature, database, or Content at any time, for any reason or for no reason at all. Contact IQ may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.
Payment can be made by credit card. Unless otherwise stated, all prices are in United States dollars.
The terms of payment may vary periodically. We may offer the paid portion of our Service through a one-time fee, a subscription plan, or otherwise. If we offer it through a subscription plan, you agree that we may rebill your credit card according to the payment terms listed on our website or otherwise communicated to you. All of the payment terms for the Service are incorporated into this Agreement by reference.
We may provide discounts to Users, subject to any limitations (such as expiry dates, how many discounts the User may apply, etc.). However, we reserve the right refuse to provide such discounts for any reason including, but not limited to, fraud, mistake on the part of our publication of information, actual or expected financial hardship, sale of all or part of our business, or any other reason.
We, at our sole discretion, may terminate your access to the Service for any reason or no reason, which may result in the forfeiture and destruction of all information associated with your account. We are not required to provide you notice prior to terminating your access to the Service. We are not required to disclose a reason for the termination of your account. Liability for refunding you, if any monies were paid, will be limited to the amount you paid for goods or services which have not been delivered, except in cases where termination or cancellation was due to your breach of this Agreement. In such a case, you agree that we are not obligated to provide any refund or other compensation.
If you are dissatisfied with the Service, these Terms, or any policy and choose to discontinue use of Contact IQ, you may do so at any time. As Contact IQ is an intangible service, it is not possible for us to accept “returns”, and we cannot offer any refunds. If you pay for the Service on a subscription basis, you may cancel your Service prior to rebilling, and we will continue to provide our Service for the paid subscription period. In short, we will not refund any unused subscriptions on a pro rata basis.
Contact IQ has no special relationship with or fiduciary duty to you. You should not rely on Contact IQ to be the sole location of your data from either your computer, tablet, mobile phone or a Third Party Account. You acknowledge that Contact IQ has no control over, and no duty to take any action regarding: which users gain access to the Service; what Content you access via the Service; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release Contact IQ from all liability for you having acquired or not acquired Content through the Service. The Service may contain, or direct you to websites containing, information that some people may find offensive or inappropriate. Contact IQ makes no representations concerning any content contained in or accessed through the Service, and Contact IQ will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Service. THE SERVICE, CONTENT, WEBSITE, APPLICATION AND ANY SOFTWARE ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
IN NO EVENT SHALL CONTACT IQ OR ITS SUPPLIERS, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE WITH RESPECT TO THE SERVICE, INCLUDING ALL CONTENT, THE WEBSITE AND THE APPLICATION, OR THE SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY (I) FOR ANY AMOUNT IN THE AGGREGATE IN EXCESS OF THE GREATER OF $100 OR THE FEES PAID BY YOU THEREFORE DURING THE 12-MONTH PERIOD PRECEDING THE APPLICABLE CLAIM; (II) FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER; (III) FOR DATA LOSS OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; OR (IV) FOR ANY MATTER BEYOND Contact IQ’S REASONABLE CONTROL. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
If you have a dispute with one or more users of Contact IQ, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”
These Terms are governed by and construed in accordance with the laws of the State of California, excluding its body of law controlling conflict of laws. Any legal action or proceeding arising under this Agreement will be brought exclusively in the federal or state courts located in the Northern District of California and the parties irrevocably consent to the personal jurisdiction and venue therein.
You agree to indemnify and hold Contact IQ, our subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of these Terms and/or arising from a breach of these Terms and/or any breach of your representations and warranties set forth above.
These Terms contain the entire agreement between between you and Contact IQ regarding the use of the Service.
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement will remain in full force and effect, and the provision affected will be construed so as to be enforceable to the maximum extent permissible by law.
Even after your access to the Service is terminated, or your use of the Service discontinues, these Terms will remain in effect. All terms that by their nature may survive termination of these Terms shall be deemed to survive such termination.
Any failure to enforce any part of these Terms shall not constitute a waiver of our right to later enforce that or any other part of these Terms. Waiver of compliance in any particular instance does not mean that we will do so in the future. In order for any waiver of compliance with these Terms to be binding, you must get a written notice of the waiver, provided by one of our authorized representatives.
The section and paragraph headings in these Terms are for convenience only and shall not affect the interpretation of these Terms.
You agree that, except as otherwise expressly provided in these Terms, there shall be no third party beneficiaries.
You and we are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by these Terms.
Pursuant to California Civil Code Section 1789.3, any questions about pricing, complaints, or inquiries about us must be addressed to our agent for notice and sent via certified mail to that agent.
